Terms of Service

Welcome to WordyBarks. These Terms of Service ("Terms") govern your use of wordybarks.com (the "Site") and any purchase you make from us. WordyBarks is a sole proprietorship owned and operated by Ali Rustamov in Pleasanton, California, USA ("WordyBarks," "we," "us"). By using the Site or placing an order, you agree to these Terms, our Refund Policy, and our Shipping Policy, which are incorporated into these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to make a purchase.

2. Products

• Our products are recordable communication buttons intended for use with pets under adult supervision. They are not toys for children and contain small parts and batteries that can be a choking or ingestion hazard for children and pets. Keep out of reach of children and do not leave pets unattended with the buttons.
• Product colors may vary slightly from images due to screen settings and production batches. Minor cosmetic variations are not defects.
• Results vary by pet. We make no guarantee that any particular pet will learn to use the buttons.
• We reserve the right to limit quantities, discontinue products, or refuse or cancel any order.

3. Pricing and payment

• All prices are in U.S. dollars. Prices, promotions, and shipping rates may change without notice.
• Sales tax is added at checkout where required by law.
• If a product is listed at an incorrect price due to an error, we may cancel the order and issue a full refund, even after confirmation.
• Payment is processed securely through Shopify Payments or PayPal. We do not store your card details.
• Optional add-on services offered at checkout (such as Priority Delivery or Shipping Protection) are services, not physical goods, and are non-refundable once the order has shipped.

4. Orders, shipping, and delivery

• An order confirmation email means we received your order, not that it has shipped. A separate email with tracking will follow.
• Shipping times and costs are described in our Shipping Policy. Delivery estimates are not guarantees; carrier delays and customs processing are outside our control.
• Orders may be cancelled or changed only within 12 hours of purchase. An order cannot be cancelled or refunded while tracking shows it is in transit. If an order is not delivered within 30 days of the ship date, we will reship or refund it as described in our Refund Policy.
• Risk of loss passes to you when the carrier marks the package as delivered to the address you provided. If a package is marked delivered but you did not receive it, contact us within 7 days and we will help you file a carrier claim. We are not responsible for packages lost or stolen after a confirmed delivery scan unless you purchased Shipping Protection.
• You are responsible for providing a correct shipping address. Orders returned to us due to an incorrect address may be reshipped at your cost or refunded minus shipping.

5. Returns and refunds

See our Refund Policy, which is incorporated into these Terms. In summary: unused items in original packaging may be returned within 15 days of delivery with prior approval; used items are not eligible for a refund; damage or defect claims must be made within 7 days of delivery with photo or video evidence.

6. Chargebacks and disputes

If you have any problem with your order, you agree to contact us at wordybarks@gmail.com and give us a reasonable opportunity to resolve it before opening a dispute or chargeback with your bank, card issuer, or payment provider. We reply within 1 business day. Chargebacks filed without first contacting us, or for orders that tracking shows were delivered, will be contested with order, tracking, delivery, and communication records. We reserve the right to refuse future orders from customers who file unjustified chargebacks.

7. Discount codes and promotions

Discount codes cannot be combined unless stated, have no cash value, and may be withdrawn at any time. We may cancel orders that abuse a promotion.

8. Reviews and user content

By submitting a review, photo, or video to the Site or tagging us on social media, you give us a non-exclusive, royalty-free, worldwide license to use it in our marketing. Reviews must reflect your honest experience. We may remove content that is false, offensive, or unrelated to the product.

9. Intellectual property

The WordyBarks name, logo, videos, photos, and Site content are our property or used with permission. You may not copy, resell, or use them commercially without written consent.

10. Warranty disclaimer

Except as expressly stated in our Refund Policy, products are provided "as is." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Some states do not allow this exclusion, so it may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, WordyBarks' total liability for any claim related to a purchase is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including injury to pets or property resulting from misuse or unsupervised use of the products.

12. California Proposition 65

Some products sold on this Site may contain chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information visit www.P65Warnings.ca.gov.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at wordybarks@gmail.com so we can try to resolve it informally within 30 days. Any dispute not resolved informally will be brought in the state or federal courts located in Alameda County, California, or in small claims court where permitted. You agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative action.

14. Changes to these Terms

We may update these Terms at any time by posting the revised version on the Site. Continued use after changes means you accept them. The version in effect at the time of your order applies to that order.
